Hi all,
in Italy few days ago we've released a Law on regulating the uses of
Trojans by Law Enforcements, otherwise discussed within internet freedom
communities as "Government Hacking" topic.
The Law has been deposited to Parliament by the MP Stefano Quintarelli
of group "Civic and Innovators" with the help from me and it's under
public consultation for 45 days.
The law proposal has been worked on since 2015, it's not just a
juridical act but enter into the context of operational and technical
aspects of regulating the uses of trojans by LEAs.
It has evolved with the contributions from many institutions
(prosecutors, antimafia, judges, police, intelligence), civil society
NGOs, juridical and technical researchers from universities, computer
forensics experts and such.
It's a highly balanced in the balance between operational efficiency of
security agencies and guarantees for the defense with a highly
sophisticated regulatory proposal, especially compared to the over
simplicistic approach taken for example by US (Rule 41), UK (IP Bill),
France and Spain.

For those who are intereted into the topic of policy advocacy and policy

p.s. It's not a Law in force, it's a Law Proposal, now it's up the
Parliament to make the right decisions!
